최근 중국은 남중국해와 동중국해에서 영유권 주장에 대한 강경한 태도를 보이고 있다. 중국의 이러한 태도는 방공식별구역을 선포하는 행위를 통해 이어도와 그 주변해역에까지 미치고 있으며, 근시일 내에 한·중간의 갈등이 심화될 가능성이 농후하다. 이 논문은 한·중간 이어도 관할권 문제를 해결하기 위한 방안을 찾는데 목적이 있다. 먼저 이어도의 위치와 전략적 가치가 어떠한지 살펴보고, 이어도가 가지는 법적인 지위와 분쟁의 쟁점이 무엇인지 알아보겠다. 이후 국제해양법측면과 국제정치학적 측면에서 양국간의 주장을 정리한 후 국제법적 측면과 우발적인 무력충돌에 대한 대비 차원에서 대응방안을 제시해 보고자 한다.

Recently, China has shown a strong attitude toward claiming sovereignty in the South China Sea and the East China Sea. This attitude of China is spreading to Ieodo and its surrounding waters, and there is a strong possibility that the conflict between Korea and China will deepen in near term. The purpose of this paper is to find a way to solve the problem of jurisdiction between Korea and China. I will first look at the location and strategic value of Ieodo, and I will examine what legal status and dispute issue.

In the following, I will summarize the arguments between the two countries in terms of international law and international politics, and then propose countermeasures against international legal aspects and contingency armed conflicts.
